Please, read the following very carefully as these terms and conditions apply to our programmes offered online and under which all bookings are accepted.

  1. Quality of our services

The prices published for our tours are directly related to the quality of services given. Only those services we can fully guarantee as having optimum price-quality ratio are offered.

All the programmes offered have been checked personally by our Agency and we guarantee their full compliance with no limitations.

Nevertheless, in the case of circumstances beyond the control of RIOJA Incoming (museums, historical monuments closed for reforms, cellars closed for harvesting, bad weather conditions for open air visits...etc…) preventing certain visits, those will be changed for others and, if such is absolutely impossible, then they will be cancelled and clients informed before their arrival. If circumstances arise during the stay which don’t allow for certain parts of the programme to be realised, clients will be informed immediately and alternatives offered.

In either case the client has the right to cancel the visit without charge and be reimbursed accordingly.

Hotels: To help you in choosing your hotel, we would indicate that hotels are classified in Spain by stars, ranging from 5 for the highest category to 1 for the lowest. To further clarify the situation, we would suggest you understand:

   2 star hotel means “standard" hotel.

   3 star hotel means “superior standard ” hotel.

   4 star hotel means “first class ” hotel.

   5 star hotel means “de luxe” hotel.

   “Small charming hotel”: It is not a category of hotel as are the above, but merely a way of informing clients that these hotels, though generally small, family run -however there are large ones- are situated in small villages or country areas of exceptional natural beauty or the buildings themselves are of special interest (old palaces, reformed monasteries… converted for hotel use) which mean they, don’t receive a higher star rating although their quality and service deserve such.
We include 2,3 and 4 star hotels in this section.

Please note that, in general, rooms are not available for use before 2 pm the day of arrival, although, if they know of your earlier arrival they will do their best to have them ready for you.

Restaurants: Regardless of the category of hotel chosen, the restaurants we recommend are always first class and typical of the region’s local cuisine and their professional chefs’ creativity. The food on offer will vary acording to the level of service chosen.

 

  2. Bookings

Any service required of RIOJA Incoming must be applied for in writing, either by e-mail or fax (phone reservations cannot be accepted) and in the same way RIOJA Incoming will confirm all bookings only by e-mail.

 

  3. Prices

All prices published are NET (*) and in EUROS, valid until 31st december 2010, and include all taxes (effective on January 1st) and service charges.

(*) Professionals may register as to see its special conditions .

Tips are not included (always voluntary in Spain) nor are any other services not specified in the itinerary.

All prices for services booked individually will be per person and the total tour price for all booked together on it and will remain unchanged once the booking is confirmed. Untill that moment no price is final and can be modified without warning if circumstances so warrant it.

 

  4. Payments

 

RIOJA Incoming only accepts two kinds of payment: Credit card (Visa, Mastercard/Eurocard), for individuals, or bank transfer, for individuals and groups... always in EUROS. Consult conditions for payment by American Express or Diners Club.

RIOJA Incoming will not add any surcharge for credit card use, but any bank transfer charges will be at the clients’ expense.

    For individual travellers:

Payment should be made to RIOJA Incoming at the latest 7 days following booking confirmation so long as the booking itself has been made at least 30 days in advance.

If a booking has services with special booking conditions (for example: train or plane tickets at special prices needing immediate issue…) RIOJA Incoming will inform the client of such and ask for this service to be paid immediately on confirming the booking.

If any booking is made less than 30 days prior to departure, RIOJA Incoming will inform the client of the latest payment date when confirming the booking.

    For groups:

RIOJA Incoming will need payment of a 10% of the final price once booking is confirmed. The remaining payment will be made following the table below.

If a booking has services with special booking conditions (for example: train or plane tickets at special prices needing immediate issue…) RIOJA Incoming will inform the client of such and ask for this service to be paid immediately on confirming the booking.

 

  5. Changes and cancellations

 

The client can always make changes to or cancel any bookings, but they must be aware such will result in charges depending on the number of days in advance they are made.

Change means any difference in the number of people travelling so long as not above 30%. Cancellation is any change of date unless the operators allow such changes without charge.

* The minimum to be charged as "service fee" will be 300,00 Eur.

 

  6. Reimbursements for changes or cancellations

RIOJA Incoming will return all money to be reimbused by the same means as payment was paid and in the same currency (EURO) for any changes or cancellations minus any charges incurred providing such changes and/or cancellations are made before the clients’ arrival.

Once the clients have started their tour no money can be reimbursed for services booked and not used.

If payment was made by Visa or Master Card, the full amount owed will be returned (if by American Express Card, minus 3%).

If payment was made by bank transfer, the amount returned will be the amount owed less the bank charges.

 

  7. Liability

Confirmed bookings will mean the knowledge and acceptance by the client that RIOJA Incoming is acting as an intermediary between the client and the operators of the different services (hotels, transport companies, guides...) and cannot accept responsibility for any injury or inconvenience to clients or damage to their belongins arising from the use of these services. If such should happen, responsibility lies with operators of the services.

RIOJA Incoming can neither accept responsibility for any act or situation occurring beyond their control like strikes, terrorist acts, robberies, adverse weather… or any similar thing affecting the normal running of the tours.

In all cases clients should inform RIOJA Incoming immediately of any eventuality which adversely affects the services booked so that RIOJA Incoming can act accordingly to minimize the effects such produce.

 

  8. Insurance

We would recommend all clients have their own private health insurance. Such insurance can also be purchased from RIOJA Incoming on confirmation of the bookings (and there you can see the covers of this insurance).

 

  9. Travel documents

 

It’s the clients’ own responsibility to carry a valid passport and all the visas and vaccination certificates required.

RIOJA Incoming will provide vouchers, by fax or e-mail, for all the services booked through them to be presented to the operators of the different services. Clients can also download the full itinerary of their chosen tours.

 

  10. Complaints and arbitration

Should any client have a complaint to make about a particular service which they consider was not received or was below standard, they must first do so directly to the people responsible for that service (hotel manager, restaurant manager, guide, driver…) so that it can be dealt with immediately.

If despite the above the problem continues, the client should inform RIOJA Incoming immediately so that they can intervene to definetely solve the problem.

The telephone, fax numbers and e-mail address of RIOJA Incoming can be clearly seen on all the clients' travel vouchers as well as in section 11 of these terms and conditions.

If despite all this and even though the situation was solved, the client's dissatisfaction continues, the client should make a full report in writing (fax or e-mail) within 30 days from the end of the trip, detailing all the points related to the problem, which will then be checked by RIOJA Incoming and an answer in writing given within 15 days of the receipt of the report.

No complaint can be accepted if received later than 30 days after the stay in La Rioja finishes.

Both RIOJA Incoming and the clients accept the jurisdiction of the Spanish Courts and, more specifically, those of La Rioja to decide on any outstanding complaints and in so doing renounce any other jurisdiction.

RIOJA Incoming refuses to accept any arbitration court for any matter arising from this contract.

In all rates RIOJA Incoming will always be subject to the legislation of the Community of La Rioja related to tours or services booked as a package.
